1. Acceptance of Terms
By accessing or using EarnByStream ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service.
2. Description of Service
EarnByStream provides real-time overlay widgets, alert systems, live chat, gift and like leaderboards, and related streaming tools for TikTok Live broadcasters. Service features may change over time.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and secure stream key. You agree to notify us immediately of any unauthorized use of your account or key.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any laws.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Transmit any viruses, malware, or malicious code through the Service.
- Harass, abuse, or harm other users through features provided by the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
5. Subscription & Payments
Certain features require a paid subscription. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our sole discretion. All prices are listed in U.S. dollars.
6. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and design, are the exclusive property of EarnByStream and are protected by international copyright, trademark, and other intellectual property laws.
7. User Content
You retain ownership of content you upload (sounds, images, frames). By uploading, you grant EarnByStream a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing the Service.
8. Free Trial
New users may be offered a free trial period. At the end of the trial, your account will be automatically limited unless you select a paid plan. Trials are limited to one per user and may require valid payment method on file.
9. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
In no event shall EarnByStream or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved in the courts of the applicable jurisdiction.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
